Terms and Conditions
End User License Agreement (EULA)
This Agreement is a legal contract between you and Flowsoft and incorporates and supplements the Apple Standard Licensed Application End User License Agreement. By downloading, installing, or using WriteIt (“Application”), you agree to be bound by these terms.
1. Scope of License
Flowsoft grants you a personal, non-exclusive, non-transferable, revocable license to use WriteIt on any Apple-branded products that you own or control.
• Restrictions: You may not distribute or make the Application available over a network where it could be used by multiple devices simultaneously.
• Intellectual Property: You may not copy, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Application or any updates.
2. AI Usage & External Services
WriteIt utilises advanced Artificial Intelligence (Google Gemini) as an External Service to provide writing suggestions.
• No Professional Advice: Output is for informational and stylistic purposes only and does not constitute legal or professional advice.
• Accuracy Disclaimer: AI can produce inaccurate, biased, or "hallucinated" information; you are solely responsible for reviewing and verifying all generated text.
• Acceptable Use: You agree not to use these External Services to harass, abuse, stalk, threaten, or defame any person or entity. Flowsoft reserves the right to change, suspend, or disable access to these services at any time without notice.
3. Data Handling & Technical Consent
• Technical Data: You agree that Flowsoft may collect and use technical data and related information—including technical information about your device, system, and peripherals—gathered periodically to facilitate software updates and product support.
• Privacy: We process data "in-flight" and do not store dictated passages. Data processing is performed by Google Gemini (Paid Tier) solely to provide the service.
4. Government Information and Restrictions
WriteIt aligns with the Australian Government Style Manual.
• Security Protocol: You must not enter "Classified," "Highly Protected," or "Top Secret" information into the Application unless explicitly authorized by your specific government department for this cloud-based tool.
5. Fees, Subscriptions and Maintenance
• Billing: Payments are processed via Apple ID; subscriptions auto-renew unless canceled 24 hours before the period ends.
• Refunds: To the maximum extent permitted by Australian Consumer Law, purchases are non-refundable through Flowsoft; requests must be directed to Apple.
• Maintenance: Flowsoft is solely responsible for maintenance and support; Apple has no obligation to provide support services for the Application.
6. No Warranty
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. FLOWSOFT DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
7. Limitation of Liability
To the extent not prohibited by law (including the Competition and Consumer Act 2010 (Cth)), Flowsofts total liability shall not exceed the amount you paid for the Application in the twelve (12) months preceding the claim (maximum 4.99).In no event shall FlowSofts total liability for all damages exceed fifty dollars (50.00). This section expressly supersedes Section (f) of the Apple Standard EULA. Flowsoft is not liable for incidental, special, or consequential damages.
8. Legal Compliance & Export Control
You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You may not export or re-export the Application except as authorised by United States law.
9. U.S. Government End Users
The Application and documentation are "Commercial Items" as defined at 48 C.F.R. S2.101, consisting of "Commercial Computer Software". Rights are granted to U.S. Government end users only as Commercial Items and with only those rights granted to all other end users.
10. Termination
This license is effective until terminated by you or Flowsoft. Your rights terminate automatically if you fail to comply with any terms of this Agreement.
11. Governing Law
This Agreement is governed by the laws of Victoria, Australia. However, for users falling under specific international jurisdictions, the governing law may default to the State of California or your usual place of residence (for EU/Swiss citizens), excluding the United Nations Convention on the International Sale of Goods.
